Nov. 25, 2025 – Katie Coleman discussed the growing use of appeals in bankruptcy cases and the challenges that presents on the latest episode of Debtwire’s Legal Lens podcast.

The episode also breaks down the impact of increasingly common litigation situations like mass torts and fights over liability management exercises intertwining with bankruptcy cases, including whether a backward-looking appeal process could disable a reorganization system that was initially sought out for advantages of speed and cost.

“The principal goal [of Chapter 11] is providing a company a fresh start and finality and the problem with the appellate process in bankruptcy… is appeals slow things down, and they challenge and ultimately may defeat finality and that always gets in the way of a fresh start,” Katie said in the episode.
