September 2015- Published in the American Journal of International Arbitration, Gerbay’s article offers an empirical assessment of the supposed judicialization of international arbitration. The article addresses two central questions: whether, as conventional wisdom suggests, there has been a recent judicialization of international arbitration; and, if so, whether this judicialization is a sign of a loss of attraction to arbitration as a dispute resolution mechanism.
