Hughes Hubbard secured a decisive victory for the firm’s client in a property dispute concerning access to a water supply for a subdivided farm in Montgomery County, Maryland.

Following a three-day bench trial, Judge Rachel T. McGuckian of the Circuit Court for Montgomery County granted our client’s motion to enforce a prior settlement agreement and ordered that the defendants must continue supplying water to our client’s property. The court also entered a permanent injunction prohibiting the defendants from interrupting the water supply unless and until a new, fully operational well providing an equivalent or greater water supply is installed.

The court declared our client the “prevailing party” in the matter for purposes of an attorney-fee shifting provision in the settlement agreement.
