Jeremy Wyeth Schulman leads Hughes Hubbard’s litigation practice in the firm’s Washington, D.C., office. Jeremy’s highly diversified practice focuses on complex commercial litigation matters, international and domestic arbitration, internal investigations and corporate counseling.

Jeremy is known as a “go to” litigator for the most consequential business disputes confronting clients in virtually every industry sector. He has represented pharmaceutical companies, major foreign and domestic financial institutions, insurance companies, trading concerns, media companies, energy joint ventures, brewers, airport development companies, real estate owners and developers, homebuilders, hotel ownership and management companies, and hotel franchisors, as well as multiple foreign governments and foreign government-owned infrastructure companies, among others.

Jeremy has a lengthy track record of success, which includes winning the dismissal of multi-billion dollar “bet-the-company” claims, procuring trial judgments and settlements in the many hundreds of millions of dollars, and handling the most difficult and sensitive matters for clients across the United States and around the world. He has been lead counsel in numerous hotly-contested corporate governance cases, as well as disputes concerning iconic real estate properties. He won a landmark Lanham Act false advertising trial, in which he obtained a substantial jury award, permanent injunction, and contempt findings against the opposing parties for violating the injunction, all of which were affirmed by a federal appeals court. He has been involved in some of the highest profile and complex international disputes emerging in recent years, including the Sumitomo Corporation “rogue trading” cases, the Bank of New York Russian money laundering scandal, and the East Timor oil and gas drilling rights cases, as well as substantial investor-state disputes in Brazil, the Philippines, and Mongolia.

Jeremy has also represented prominent trial lawyers when they themselves have needed litigation counsel, including a well-known national association of trial lawyers in a major loan securitization dispute, a senior official in the Department of Justice in an intellectual property lawsuit, and a former judge on what is now the Maryland Supreme Court in a construction matter.

Jeremy’s primary focus is prosecuting and defending actions involving breach of contract, fraud, civil RICO, breach of fiduciary duty, negligent misrepresentation, misappropriation of trade secrets, lender liability, creditor’s and debtor’s rights, fraudulent conveyances, trademark and copyright infringement, false advertising, unfair competition, defamation, invasion of privacy, products liability, and federal and state securities law violations.

Jeremy regularly appears in state and federal courts across the United States, including New York, the District of Columbia, Virginia, Maryland, Florida, Delaware, California, Illinois, Texas, Pennsylvania, Ohio, Massachusetts, Louisiana, Connecticut, New Jersey, Nevada, Georgia, North Carolina, and Wisconsin, as well as various foreign and domestic arbitral tribunals.

Jeremy is tenacious in his approach to litigation, handling cases with a sense of urgency and a focus on efficiency. Although he places great emphasis on creative problem solving, frequently steering disputes to resolution through informal negotiation or mediation, Jeremy is also an experienced trial lawyer. He has successfully handled numerous contested proceedings, including jury and non-jury court trials, merits arbitration hearings, temporary restraining order and injunction hearings, dispositive motions hearings and other evidentiary proceedings.

Highlighted Matters

  • Representation of pharmaceutical company and its principals as national litigation counsel handling Lanham Act false advertising, contributory false advertising, trademark infringement, breach of fiduciary duty, trade secrets/know how, and tortious interference cases in federal and state courts in Maryland, Wisconsin, California, Georgia, and Florida. Obtained $18 million jury verdict and permanent injunction, and won findings of contempt, all of which were affirmed by the U.S. Court of Appeals for the Fourth Circuit. Defeated more than 50 counterclaims and won summary judgment dismissing separate $160 million counter-suit.
  • Representation of real estate-backed specialty lender in dozens of loan disputes in New York and Illinois, including $30 million wire fraud case. Won summary judgments or settlements in excess of $30 million.
  • Represented prominent group of bio-technology companies and their principals as national litigation counsel handling loan, securities, and contract disputes in New York, Maryland, Delaware, and Massachusetts, including $230 million loan dispute and $73 million licensing agreement litigation.
  • Representation of private equity firm in litigation over its interests in $480 million petroleum company sale. Won summary judgment on all seven counts of Amended Complaint, won dismissal of all eleven counts of the opposing parties’ counterclaims, won finding that adversary pressed litigation in bad faith and without substantial justification, and obtained recovery valued at $65 million, plus reimbursement of all of our client’s attorneys’ fees and costs.
  • Representation of dietary supplement licensor in California federal litigation concerning Lanham Act false advertising, trademark infringement, and breach of a trademark licensing agreement.
  • Representation of senior U.S. Department of Justice official in copyright litigation.
  • Representation of Washington, D.C. trade association in litigation concerning $90 million failed loan.
  • Representation of one of Japan’s largest conglomerates in multi-billion-dollar litigation against two leading New York-based banks arising from their involvement in one of the largest rogue trading scandals in history.
  • Representation of a celebrity chef in litigation concerning ownership of successful restaurant ventures.
  • Representation of minority ownership group in buy-sell dispute concerning the sale of a $150 million office building in Washington, D.C.
  • Representation of putative seller of Orlando, Florida apartment complex in litigation with buyer over a disputed purchase and sale agreement.
  • Representation of leading U.S. homebuilder in litigation concerning $120 million real estate acquisition in the Washington metropolitan area.
  • Representation of 50% owner of limited liability company owning $50 million Washington, D.C. office building in dispute concerning sale of property.
  • Representation of the principals of a Florida-based technology company in multiple litigations against two leading financial institutions in connection with disputed securities margin agreements.

  • Representation of New York-based real estate company concerning various disputes with major hotel management company relating to hotels in Florida and Puerto Rico.
  • Representation of owner of Downtown Washington hotel in AAA arbitration against major hotel management company concerning proposed hotel renovation.
