William Stein Quoted by International Bar Association on Trump v Casa

Sept. 9, 2025 – William Stein was quoted in an International Bar Association article about the U.S. Supreme Court’s ruling in Trump v Casa, which impacts the ability of judges to impede presidential policies, while still allowing those policies to be challenged through class actions.

In the article, Stein explained that the primary impact of the ruling is that litigation against Trump’s executive orders will take longer and require more resources, because it’s more difficult to put together a class action than an individual case.

“It’s not simply a matter of drafting a complaint. You have to put together some evidence supporting the contention that you meet all the requirements of Rule 23, so that the court has a basis to certify a class,” Stein said.

The silver lining for the groups challenging executive orders, according to Stein, is that recent class actions will be more procedurally defensible if they end up before the nation’s highest court.

“Whether they will agree on the substance of the case, the merits of the case; is an entirely different question,” Stein said.
