Dec. 2, 2025 – Hughes Hubbard secured preliminary approval of $141.8 million worth of class settlements for antitrust claims lodged against landlords – including Hughes Hubbard client Bozzuto Management Company – aimed at resolving multidistrict litigation in the District Court for the Middle District of Tennessee.

The plaintiffs’ complaint alleges Bozzuto and other real estate companies conspired to raise rents in multiple U.S. cities using RealPage products – property management software that offers estimates and recommends market rents algorithmically – to exchange non-public data in order to align prices and reduce competition.

Last month, the firm assisted in drafting a brief rejecting state Attorney General arguments against the settlements, contending that the settlements release the companies from similar antitrust claims filed by the attorneys general on behalf of the residents living in their states. HHR is defending Bozzuto in three of those actions, in New Jersey, Maryland and the District of Columbia.

On Nov. 25, U.S. District Judge Waverly D. Crenshaw Jr. granted preliminary approval for 26 settlements in the multidistrict litigation to resolve rent price-fixing claims for a certified settlement class who paid rent to landlords, property owners, or property managers that used RealPage’s revenue management software.
