The article discusses how art galleries and auction houses can make these mistakes, including from mismanagement or deliberate misconduct.
Weiner specifically discussed how lost artwork is valued in these instances, something that is further complicated by auction house consignment agreements.
“Auction houses usually limit by contract their liability for lost works,” Weiner said. “Christie’s, for example, typically limits it to the proceeds of sale (if the work is lost after its sale) or the mid-point between the high and low estimates (if the work is lost prior to its sale at auction).”
