Preparing Life Sciences Companies for Post-Election Investigations
Pricing agreements and related government commitments will likely see renewed Congressional scrutiny.
Highlights
Pre-election inquiries preview post-election scrutiny of drug pricing agreements and TrumpRx participation.
Manufacturers should be prepared to defend their agreements and their public statements about them, particularly statements about savings and access.
Preparation should cover commercial arrangements and government commitments, with fact gathering coordinated across company functions.
Prescription drug pricing will likely become a prominent focus of legislative oversight with Democrats taking majorities in Congress next year. Manufacturers should prepare to explain not only their pricing agreements with the Administration, but also the patient benefits, commercial arrangements and government commitments associated with them.
Congressional inquiries this past year provide a preview of what this scrutiny will look like. Democratic lawmakers requested extensive information about covered products, pricing methodologies, TrumpRx participation and potential tariff or regulatory benefits. With Democrats gaining control of both the House and Senate, companies can expect the majority to leverage its subpoena power to expand those investigations.
Explain who receives advertised prices
A public announcement about lower prices is only the starting point. Companies should be able to identify which products are covered, which patients and payor groups are eligible, how long commitments last and how prices are determined.
One inquiry from last year sought details about international benchmarks, calculation formulas and the treatment of newly launched products. Another similarly inquired how and why prices differ by payor or self-pay status. Manufacturers should prepare explanations that distinguish list prices, discounts and patient costs rather than treating them as interchangeable.
Substantiate patient benefits
Companies should review the evidence supporting public statements about cost savings and access. The analysis should identify the comparison prices, eligible populations, relevant periods and assumptions underlying any projected benefit.
Where outcomes remain prospective, companies should distinguish commitments from demonstrated results. Legal, pricing and market access teams should gather information supporting their company’s public messaging and anticipate questions about the alignment of that messaging with the scope of the agreements and available implementation data.
Examine surrounding arrangements
Congressional scrutiny will likely extend beyond the price itself. Congressional letters from Democratic members of Congress have asked about relationships with discount platforms, vendor compensation, operational infrastructure and data-sharing arrangements associated with TrumpRx. Companies should map those relationships and identify records needed to explain how products are selected, listed and made available.
The inquiries also concern reported tariff relief, potential regulatory benefits and the distinction between newly announced investment and already planned spending. Manufacturers should document what was requested, promised and implemented.
Prepare a coordinated factual response
A pricing inquiry requires coordination among legal, commercial, government affairs, privacy, finance and research teams. Companies should establish responsibility for each subject and identify supporting records before responding.
Executive preparation should focus on explaining complex arrangements clearly. Confidentiality practices should also be considered, including contractual provisions governing disclosure in response to Congressional inquiries.
Manufacturers should not wait until the new Congress is seated to begin this work. A documented account of pricing terms, patient benefits and associated commitments will support a more disciplined, coordinated response to the inevitable Congressional questions.
